We recenlty resolved the claim of a pedestrian who was struck while in the crosswalk. She absolutely had the right of way when she was crossing the street. A distracted driver apparenlty did not notice her and struck our client.

Our client reported that she was not in pain, but was taken to the hospital and given a series of diagnostic tests. The result of these was that, while she was bruised and scratched up, she was not physically injured. This is remarkable given the speed of the car that struck her and the physics of the accident.

The real long-term impact was our client's anxiety any time she was in or near a car.

We had to fight the insurance company to get the policy limits, but the insurance adjuster eventually saw that our client's anxiety was tied directly to the accident and that we were not going to take anything less than all of the money available.
